TERMS AND CONDITIONS FOR REAL ESTATE READY MEMBERSHIP PROGRAM
1. Agreement Overview
These Terms and Conditions (the "Agreement") govern the Real Estate Ready Membership Program (the "Membership Program") provided by AJ Stafford Property Advocates ("We," "Us," "Our"). By subscribing to the Membership Program, you ("Member," "You," "Your") agree to the terms and conditions set forth herein.
2. Membership Subscription
2.1. The Membership Program operates on a subscription-based model. The standard subscription fee is $49 per month, payable monthly in advance.
2.2. Members may apply special discount codes as offered from time to time, which will adjust the subscription fee accordingly.
2.3. We reserve the right to change the subscription fee at any time. Current members will be locked in at their original subscription fee for the duration of their existing membership agreement, unless they opt-out and re-subscribe.
2.4. The Membership will automatically renew at the end of each billing cycle unless the Member cancels their subscription prior to the renewal date.
2.5 You agree to any automated billing process approved by you and that this will continue until any agreement is properly terminated.
3. Payment and Billing
3.1. Membership fees will be automatically charged to the payment method provided by the Member on a monthly basis.
3.2. Members may cancel their subscription at any time by providing written notice. Cancellation will be effective at the end of the current billing cycle, and no refunds will be issued for partial months.
3.3. We do not offer refunds, except as required by law. If you experience any issues with the Membership Program, please contact us to discuss potential resolutions.
4. Access to Content and Resources
4.1. Members will have access to exclusive content, resources, and expert advice provided through the Membership Program.
4.2. All content and resources provided through the Membership Program are protected by copyright and other intellectual property laws.
Members are prohibited from copying, sharing, or distributing any content or resources without Our express written permission.
4.3. Unauthorised use or distribution of Our content and resources may result in the termination of the Member's subscription and potential legal action.
4.4. The intellectual property rights in all content, resources, and materials provided through the Membership Program remain the property of AJ Stafford Property Advocates or its licensors.
4.5 We may recover any loss or damage from breach of these terms and conditions.
5. Additional Services
5.1. Members may have the option to upgrade to additional services, including but not limited to:
● The Off-Market Property Portal;
● The Assess and Negotiate Service; and/or
● The Full-Service Package
5.2. Upgrades to the Off-Market Property Portal will require an application process, including a questionnaire to determine the Member's eligibility (e.g., pre-approved finance and available deposit funds). To avoid conflicts, only one applicant with a specific search criteria will be accepted at a time, with a waiting list provided for others.
5.3. Fees for these additional services will be determined during the consultation phase and are subject to separate agreements.
5.4. Members upgrading to the Assess and Negotiate Service or Full-Service Package will be required to sign further agreements specific to those services.
6. Application Process for Off-Market Property Portal
6.1. Members interested in the Off-Market Property Portal must complete an application, which includes determining their financial readiness and specific search criteria.
6.2. If multiple applicants share the same search criteria, priority will be given to the first applicant, with others placed on a waiting list in order of registration.
7. Member Conduct
7.1. Members are expected to conduct themselves in a professional and respectful manner during all interactions with Us and within the Membership Program, including forums, webinars, and live sessions.
7.2. Any behavior deemed inappropriate, disruptive, or abusive may result in the termination of the Member’s access to the Membership Program without notice or refund.
8. Termination
8.1. We reserve the right to terminate this Agreement with immediate effect by providing written notice to the Member if any of these terms and conditions are breached or at Our discretion.
8.2. Members may terminate their subscription at any time by providing written notice, with termination effective at the end of the current billing cycle.
8.3. In the event of termination, Members are reminded that fees paid are non-refundable.
9. Limitation of Liability and Disclaimer of Warranties
9.1. We make no representation, guarantee, or warranty regarding the suitability of the Membership Program or any additional services for the Member's specific needs. The services are provided "as is" and "as available" without any warranties, express or implied.
9.2. The Member acknowledges that they should seek independent legal, financial or other professional advice as needed.
9.3. To the maximum extent permitted by law, We are not liable for any loss or damage arising from the Member's use of the Membership Program or additional services.

9.4 The information provided within the Real Estate Ready Membership Program is intended solely for educational and general informational purposes. It is not tailored to the specific financial or legal circumstances of any individual member and should not be relied upon as financial, legal, or tax advice.
9.5 The content of this program has been prepared without consideration of your personal objectives, financial situation, or legal needs. Accordingly, before acting on any information provided within this program, you should carefully assess its relevance and appropriateness to your individual circumstances.
9.6 You should seek independent professional advice from qualified financial, legal, and/or tax advisors before making any decisions or taking any actions based on the information provided in this program. Your decisions and actions should be informed by the guidance of professionals who understand your unique situation and can provide advice tailored to your specific needs.
9.7 By participating in the Real Estate Ready Membership Program, you acknowledge that you are solely responsible for your own decisions and that We and the program’s creators and facilitators are not liable for any outcomes resulting from the use of the information provided; and
will make no claim in regard to the Real Estate Ready Membership Program as it sprecifically applies to You.
10. Force Majeure
We are not liable for any failure or delay in the performance of Our obligations under this Agreement if such failure or delay is caused by events beyond Our reasonable control, including but not limited to natural disasters, pandemics, government actions, or other unforeseen circumstances.
11. Use of Third-Party Services
11.1. The Membership Program may integrate with or utilize third-party services or platforms. We do not control these third-party services and are not responsible for their performance, availability, or terms of use.
11.2. The Member acknowledges that use of third-party services is at their own risk and is subject to the terms and conditions of those third parties.
12. Confidentiality
Any confidential information shared by the Member or AJ Stafford Property Advocates during 1-1 services or within the Membership Program shall be kept confidential and not disclosed to any third party without written consent, except as required by law.
13. Non-Compete and Non-Solicitation
Members are prohibited from using the resources or information provided in the Membership Program to start a competing business or to solicit other Members for services that compete with those offered by AJ Stafford Property Advocates.
14. Changes to Terms and Conditions
We reserve the right to modify these Terms and Conditions at any time. Members will be notified of any significant changes, and continued use of the Membership Program after such notification will constitute acceptance of the updated terms.
15. Governing Law
This Agreement is governed by the laws of the State of Victoria, Australia. Any disputes arising under this Agreement shall be resolved in the courts of Victoria.
16. Acceptance of Terms
By subscribing to the Real Estate Ready Membership Program, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
